Terms of Service

These Terms of Service govern your access to and use of the Aetheria OS platform and related services provided by Aetheria Technologies ("Aetheria," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Aetheria OS platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Aetheria OS is a cloud-based hospitality operations platform that provides property management tools, real-time dashboards, department coordination, guest communication, financial analytics, and AI-assisted operational guidance. The Service is provided on a subscription basis.

3. Accounts & Access

You must create an account to use the Service. You are responsible for:

- Maintaining the confidentiality of your login credentials. - All activity that occurs under your account. - Ensuring that account information is accurate and up to date. - Assigning appropriate role-based permissions to your staff.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription & Billing

Paid plans are billed in advance on a monthly or annual basis. Prices are listed on our pricing page and may be updated with 30 days' written notice. Refunds are handled according to our refund policy. Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

5. Your Data

You retain all ownership rights to the data you input into the Service ("Customer Data"). We do not claim ownership of Customer Data. You grant us a limited license to host, process, and display Customer Data solely to provide the Service.

You are responsible for ensuring that any personal data you upload (e.g., guest information) complies with applicable data protection laws, including obtaining necessary consents.

6. Acceptable Use

You agree not to:

- Use the Service for any unlawful purpose or in violation of any applicable laws. - Attempt to gain unauthorized access to the Service, other accounts, or related systems. - Reverse-engineer, decompile, or disassemble any part of the Service. - Transmit malware, viruses, or any code designed to disrupt the Service. - Resell, sublicense, or redistribute access to the Service without written consent. - Use automated scripts to scrape or extract data from the Service beyond provided APIs.

7. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Aetheria Technologies and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets. Feedback or suggestions you provide may be used by us without obligation.

8. Service Availability & SLA

We target 99.9% uptime for the Service, excluding scheduled maintenance. We will provide reasonable advance notice of planned downtime. We are not liable for interruptions caused by factors beyond our reasonable control, including internet outages, third-party service failures, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Aetheria Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising from your use of the Service. Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Aetheria Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, you may request an export of your Customer Data within 30 days. After that period, we may delete your data in accordance with our data retention policies.

12. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts in Denpasar, Bali, Indonesia.

13. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
